Legally because the tail gate when open over hangs more than 150 mm and not more than 1200 mm it would be ok but you would have to have a red flag on it that my take anyway
I wonder if a strip of hi-vis/reflective vynil would suffice instead of a flag. Would be a lot neater, and would be hidden when you close the top gate.
I would think they would get you for either neg driving or unsecure load if you had anything in the back(mattress etc). That is of course unless you were not drawing attention to yourself......:Chin: in a Sandman panelvan
I had checked with the local SA authorities on the matter a few years ago, my personal understanding of the discussion was that the top tailgate is considered part of the vehicle and can be open while driving.
obviously you pose the unsecured load thing and it would be dependant on a persons point of view, but really anything unsecured in the back of a van is no different to a spade chucked in the back of a ute with no tarp.
just note that this is my understanding and not the 100% black and white letter of the law - it certainly pays to check, ring the local police station and ask the question - just get the officers ID number in case you need to back up your information.
ive driven plenty of times in the sinbox with top gate open just for the fun of breathing fumes and too look cool..even got followed by mr plod one day and didnt get pulled over...
